1. About the App

Moku is an iOS focus-tracking application that helps you build and maintain screen-free habits. The App uses your device's motion sensors to detect when your iPhone is placed face down and automatically tracks focus sessions. It also supports manual session tracking, streak management, daily focus goals, session history, and optional syncing with iCloud.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under the age of 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code of the App
• Use the App in any way that violates applicable law or regulation
• Attempt to interfere with or disrupt the integrity or performance of the App

4. In-App Purchases — Moku Pro

The App offers an optional one-time in-app purchase called Moku Pro, which unlocks additional features including full session history, advanced statistics, custom app icons, and shareable focus cards.

• Moku Pro is a one-time purchase. There is no subscription or recurring charge.
• All purchases are processed by Apple through the App Store and are subject to Apple's payment terms and refund policies.
• We do not collect or store any payment information. All billing is handled entirely by Apple.
• Purchases are non-refundable except as required by applicable law or as permitted by Apple's refund policy.
• Moku Pro is tied to your Apple ID and can be restored on any device associated with the same Apple ID via the "Restore Purchase" option in the App.

5. iCloud Sync

The App optionally syncs your data — including focus sessions, preferences, and statistics — using iCloud (Apple's CloudKit service). This sync is associated with your personal Apple ID and iCloud account. We do not operate our own servers and do not have access to your synced data. Use of iCloud is subject to Apple's iCloud Terms and Conditions.

6. Motion Sensor Access

The App uses your device's built-in motion sensors (accelerometer and gyroscope) via CoreMotion to detect when your phone is placed face down. This data is processed locally on your device in real time and is never transmitted or stored beyond what is necessary to track your current session.

7. Notifications

The App may request permission to send you local notifications, including daily reminders, personal best alerts, and session-related notifications. These notifications are generated and delivered entirely on your device. You can disable them at any time in your iPhone's Settings.

8. Intellectual Property

The App and all of its content — including its name, logo, design, code, and copy — are the property of Jolted and are protected by applicable intellectual property laws.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Jolted shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or service interruption.

Our total liability to you for any claims arising out of or related to these Terms or the App shall not exceed the amount you paid for Moku Pro, if any.

11. Changes to the App

We reserve the right to modify, suspend, or discontinue the App or any feature thereof at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nice, France.
